01

## Designated agent

In short — registered with the US Copyright Office.

Unispawn has a designated agent to receive notifications of claimed infringement under section 512(c) of the US Copyright Act. The registration is on file with the United States Copyright Office as DMCA-1078000.

DMCA Agent, Unispawn, Assendorperdijk 1, 8012EG Zwolle, Netherlands. Telephone +31 6 20636077. Email [legal@unispawn.io](mailto:legal@unispawn.io).

02

## Sending a notice

In short — use the form; it collects what the law requires.

The quickest route is the notice form, which asks for each element a valid notice needs and will not submit without them: [unispawn.io/legal/notice](https://unispawn.io/legal/notice). You can also write to the agent above.

A notice has to identify the work, identify what on Unispawn you say infringes it precisely enough for us to find it, give us a way to reach you, and carry two statements: that you believe in good faith the use is not authorised, and that the information is accurate — the second on penalty of perjury.

03

## What happens next

In short — a person reads it; the author is told.

A person reviews every notice. No automated system decides one. If we act, the author is told that a notice was made and by whom, which is required and is why a notice must be signed.

Deciding a notice is not something we do quickly for its own sake. A game coming down is somebody's work coming down, and a notice that turns out to be wrong has already cost them.

04

## If you think we got it wrong

In short — authors can push back.

An author whose game was removed over a notice can send a counter-notice to the same address. It has to identify what was removed, say under penalty of perjury that you believe it was removed by mistake or misidentification, and give contact details.

Both directions carry a warning worth reading twice: section 512(f) makes a person who knowingly misrepresents that material is infringing — or that it was removed by mistake — liable for the damages that misrepresentation causes.

05

## Repeat infringement

In short — accounts that keep doing it are closed.

We keep a record of notices we have acted on, and an account that repeatedly publishes material it has no right to publish is closed. Which notices counted, and why, is written down at the time rather than reconstructed afterwards.

06

## Outside the United States

In short — the same address, the same person reading.

Unispawn is established in the Netherlands and the Digital Services Act applies to what we host. Notices under EU law go to the same address and the same person reads them; you do not need to work out which regime you are in before writing.
